1. The agreement
These terms are an agreement between you and NijeesWeb ("NijeesWeb", "we") for the use of the NijeesWeb website builder, the customer portal and the websites you create with it (together, the "Service"). By creating an account or buying a plan you accept them. If you use the Service for a business, you confirm you are authorised to accept these terms on its behalf.
2. Your account
- You must be 18 or older and give accurate details.
- Keep your passwords private. You are responsible for what happens under your account and your websites' admin logins.
- Tell us straight away at support@nijeesweb.com if you think someone else has access.
3. Plans, payment and renewal
- Each plan provides one website for the period shown at purchase (one year unless stated otherwise), starting on the day payment is confirmed.
- Prices are in Indian rupees and are paid in advance through PhonePe. Prices in Indian rupees, billed once a year. GST (18%) is added at checkout.
- Each plan sets how many pages, sections on each page, image and video galleries, gallery items and storage a website may have, and whether it includes the mega menu, as shown on the pricing page. Nothing on a website is deleted for being above a limit: what is past the limit is switched off — no longer shown on the website — until there is room for it again.
- Plans do not renew automatically. At the end of the period your website goes offline until you renew from your dashboard.
- You may upgrade to a higher plan while a website is active. The price is the new plan's cost for the remaining days, less the unused value of your current plan; the end date does not change.
- You may add add-ons (extra pages, galleries, storage or features) to an active website. An add-on bought during a period costs its yearly price for the days left in that period, and is then included in the website's renewal unless you switch it off before renewing.
- Refunds are covered by our refund policy.
- We may change prices for future purchases and renewals; a change never affects a period you have already paid for.
4. Domains and SSL
You need your own domain name, bought from a registrar of your choice; it remains yours and is not part of the Service. To connect it you point its DNS to our servers (currently 13.202.27.61). We issue and renew a free SSL certificate for a connected domain automatically. You are responsible for keeping your domain registered and its DNS records correct.
5. Your content
You own the text, images, videos, designs and data you put into your websites ("Your Content"). You give us a licence to host, store, copy, display and process Your Content only as needed to run, secure and improve the Service and to show your website to its visitors. You confirm you have the rights to Your Content and that publishing it is lawful.
Templates, themes and designs we provide may be used and changed freely on your NijeesWeb websites; they remain our property and may not be resold as templates.
6. Acceptable use
You must not use the Service to:
- publish anything unlawful, defamatory, obscene, hateful or that infringes someone else's rights;
- phish, deceive or impersonate another person or organisation, or collect passwords or payment details under false pretences;
- distribute malware, spam or unsolicited bulk messages;
- attack, probe or overload our systems or other customers' websites, or get around any limit or security measure;
- break the Information Technology Act, 2000, the rules under it, or any other applicable law.
We may remove content or suspend a website that breaks these rules, or when required by law, and will tell you why unless the law prevents us.
7. Your visitors' data
If your website collects personal data — for example through a form — you are responsible for doing so lawfully and for telling visitors how you use it. We process that data only on your behalf, as described in our privacy policy.
8. Availability and changes
We work to keep the Service fast and available, but we do not guarantee it will be uninterrupted or error-free; maintenance, upgrades and events outside our control can cause interruptions. We improve the Service continually and may add, change or remove features. Keep your own copies of important content and images.
9. Ending the Service
You can stop using the Service at any time; because plans do not renew automatically, nothing more is charged. When a plan ends your website goes offline and its content is kept for a reasonable period so you can renew; after that it may be deleted. We may suspend or close an account that seriously or repeatedly breaks these terms.
10. Liability
To the extent the law allows, the Service is provided "as is", and we are not liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the affected website in the twelve months before the claim. Nothing in these terms limits any liability that cannot be limited by law, or your rights as a consumer.
11. Indemnity
You agree to compensate us for losses arising from claims by others about Your Content or your breach of these terms.
12. Governing law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of India.
13. Changes and contact
We may update these terms; the date at the top shows the latest version, and for significant changes we will tell you in advance by email or in your dashboard. Questions: support@nijeesweb.com.
